These general conditions apply to any residential hotel or event rental contract, signed between, on the one hand, the agent mandated by HEALTHY TOURISM SARL, and, on the other hand, the client whose name, signature and N ° passport appear at the foot of this document, for the rental of the luxury villa named L'ALBAICIN located in Marrakech, Morocco. Said contract only comes into force on condition that the customer has signed these general conditions for agreement.
The following expressions, except in circumstances where the context requires it, have the meanings as follows:
L'ALBAÏCIN: the villa of the same name, its annexes and its permanent staff provided by the lessor, located km 11, route de l'Ourika, Marrakech, Morocco and operated by the SARL “HEALTHY TOURISM”. In the event that in addition to the villa L'Albaicin the client also rents the villa Granada, located on the same property, the term "l'Albaicin" in the following includes both villas.
CUSTOMER: any contractor of HEALTHY TOURISM SARL acting in his own name or represented by an agent for the rental of “Albaïcin”.
LESSOR: HEALTHY TOURISM SARL or its duly authorized legal representative.
AGENT: any company mandated by HEALTHY TOURISM SARL to sign an Albaicin rental contract on its behalf with the client.
SPECIAL CONDITIONS: the contract signed between, on the one hand, the lessor or his agent, and, on the other hand, the client and which contract regulates the specific conditions for the rental of the Albaicin, for events or for residential purposes .
CONTRACT: all contractual reservation documents, i.e. these general conditions, the specific conditions of the direct contract between client and lessor or the agent of the latter and all correspondence between the parties responding to possible specific requests from the client, below hereafter referred to as “the contract”.
RESIDENT: any natural or legal person present at Albaicin during the duration of the contract with the authorization of the lessor, with the exception of permanent domestic staff provided by the lessor.
FORCE MAJEURE EVENT: any unforeseeable, irresistible and external event that the lessor, despite the usual and necessary precautions, was unable to avoid, such as and not limited to bad weather, storms, hurricanes, floods, fire, insurrections, riots, strikes, boycotts, conflicts relating to labor rights, war – declared or not –, compliance with any government law, regulation, action, recommendation or action of government (Moroccan or foreign) acting or under claim of authority.
The contract only becomes final when the customer has signed for agreement an original copy of these general conditions, the special conditions and after having paid the first deposit provided for by the special conditions.
The lessor reserves the right to cancel, without any compensation due to the customer, the contract in the event that the deposit, deposit(s) or payment for optional services chosen by the customer have not been received by the lessor within the deadline. contractual.
Any cancellation by the customer of the reservation results in the complete loss to the lessor of the deposit(s) paid.
If the customer does not appear on the start date of the rental provided for in the Special Conditions, any deposit received will in this case be definitively acquired by the lessor.
The possible early departure of the client does not give right to any reimbursement of rent paid.
4. RENT, DEPOSIT AND BENEFITS
The rent will be paid in advance by installment in accordance with the schedule provided for in the special conditions agreed between the client and the lessor or his agent. All bank charges are the responsibility of the customer, including payments by credit card, 3% commission.
The deposits paid correspond to the rental period provided for in the contract and are not transferable to another period without the agreement of the lessor.
The deposit agreed in the special conditions will be paid by the customer to the lessor at the latest on the start day of the rental and before handing over the keys, under penalty of automatic cancellation of the contract. In this case, the rent deposits already paid by the customer will remain definitively acquired by the lessor.
Any damage or failure noted at the end of the stay by the lessor and not reported by the customer within 24 hours after their arrival on the premises may be invoiced by the lessor to the customer and, in the event of non-payment, may be retained by the lessor on the guarantee deposit paid by the customer before his departure. In the event of insufficient security in this respect, the customer remains liable for the balance thus not collected. In the event of a balance of all accounts in favor of the customer, the lessor undertakes to return this balance within a maximum period of one month from the date of notification of the balance in his favor.
In the event that the repair cannot be completed before receiving the next customer, and prevents the latter from properly enjoying their rental, the rental amount will be paid by the customer who caused the damage.
Lunches and dinners must be paid in advance by the client upon arrival at L'ALBAICIN. The customer has the right to cancel one or more meals and will be reimbursed for the corresponding amount, provided they notify the management of L'Albaicin 24 hours in advance.
If the customer wishes to bring their own drinks such as alcohol, a corkage fee of €5/barrel on wine and €15/barrel on champagne/strong alcohol will be required.
The rates published by L'ALBAICIN are inclusive of VAT and excluding Tourist Tax.
Rental VAT: 10%
Event VAT, meals, drinks: 20%
Tourist tax: 33DH per person per day.
The list of optional services that the lessor is able to provide to the customer is given to the customer before the start of the rental. The services chosen from this list by the customer are payable in advance before the start of the rental, with the exception of services, such as drinks and snacks, the quantity and/or amount of which will only be known at the end. of rental. These services are payable before the client leaves.
5. OCCUPANCY OF THE PREMISES
Arrival/departure of the customer:
Check in is between 2 p.m. and 6 p.m. and check out between 10 a.m. and 12 p.m. In the event of arrival or departure outside these times, a supplement is due by the customer in the amount of €100.
The customer is required to communicate to the lessor before the start date of the residential rental the identity of the people planned for the stay. In order to respect the administrative obligations regarding tourism in Morocco, the client accepts that upon arrival a photocopy will be made of the passports of the people appearing on this list and that a police form will be completed for each of them. Police records and photocopies of passports are kept at the disposal of the competent Moroccan administrative authorities.
The client undertakes to communicate to the lessor any modification during the rental of the list of people residing at Albaicin. Any presence of residents not declared on the list mentioned above authorizes the lessor, after request for compliance not followed by the client, to terminate the contract with immediate effect.
The lessor is authorized to verify at any time that the occupation of Albaicin complies with this contract and that the identity of the residents corresponds to the list of residents provided by the client.
The number of people residing at Albaicin cannot under any circumstances exceed a total of 15 (6 double beds and, if necessary, 3 extra beds). In the event that the client rents, in addition to the Albaicin, partially or fully the Granada villa, the total number of residents allowed is 25 residents.
The customer is not allowed to employ domestic staff of his own choosing.
The customer undertakes not to damage in any way the walls, floors, ceilings, furniture, accessories and other equipment, interior or exterior, of the Albaicin, nor to cause damage to the plantations of the private park which is part of it. The client is jointly and severally liable for any failure or damage caused by his guests, residents or service providers contracted by him.
The use of Albaicin is for private and temporary use, excluding any commercial or artisanal activity of any nature whatsoever.
The customer is prohibited from any modification of the furnishing, decoration, technical installation or layout of the Albaicin.
At the end of the rental, the customer undertakes to restore, at his own expense, the premises as they were at the start of the rental. The customer also undertakes to remove from the premises any goods, residues or other objects not inventoried in the inventory established at the start of the rental, failing which the lessor will have the necessary action taken at the customer's expense.
The lessor declines all responsibility for the disappearance of or damage caused to property belonging to the customer, his guests (residents or not), participants in events or suppliers of products and services sponsored by the customer.
The client accepts without reservation the access and execution of the assigned functions of the permanent staff assigned by the lessor to the Albaicin: director, security & maintenance manager, butler, waiter, cook, assistant cook, maids and gardener. This staff is expected to serve a maximum of 15 residents. In the event of additional rental of the Granada villa, the staff can be reinforced with a waiter, a kitchen helper, a chambermaid.
The customer is required to respect meal times:
breakfast 8:00 a.m. – 10:30 a.m.,
lunch 12:00 – 15:00,
dinner 8:00 p.m. – 11:00 p.m.
After 11:00 p.m., with or without non-resident guests, a supplement applies covering staff overtime and other charges arising from the event at a rate of €100 per hour. The client is allowed to receive non-resident guests, provided that their number does not exceed the number of residents. He undertakes to inform the lessor who will hire on behalf of the client any additional domestic staff that may be necessary. He also undertakes to pay the lessor any consumption or other costs resulting from his guests. Unless expressly authorized by the lessor, the consumption at L'Albaicin of drinks brought by the customer is prohibited. Otherwise, a corkage fee of €10/bottle of wine and €20/bottle of champagne will be required.
Smoking (cigarettes, cigars, shisha) is prohibited inside L'Albaicin buildings.
Any event other than provided for in the Special Conditions where the number of non-resident participants is greater than the number of resident people is only authorized after written agreement from the lessor. The lessor and/or its staff are authorized to refuse access to the Albaicin to any person not authorized in this capacity.
The customer accepts and undertakes to respect the conditions and instructions for the practical use of the Albaicin facilities as specified in the Albaicin Practical Guide, a copy of which is available in each room.
The customer is required to respect staff service hours.
The client will ensure that the noise level reached during the rental, whether by the equipment included in the Albaicin inventory or by the musicians or other contractual workers hired by the client, does not disturb the Albaicin's neighbors. In the event of non-compliance, the lessor reserves the right to intervene to reduce the noise level and, failing that, to stop the event.
The customer agrees not to receive, and undertakes, if necessary, to expel from Albaicin, any person whose behavior is likely to cause harm, materially or morally, to Albaicin. If the customer does not respect this obligation, the lessor or its permanent staff have the right to expel or prohibit access to Albaicin any person whose behavior or reputation suggests that they could cause harm. , materially or morally, to Albaicin.
More particularly, the lessor has the right to terminate the contract at any time, to the exclusive wrong of the client, in the event that the contract turns out to be used as a support for demonstrations, actions or behavior contrary to public order or the good morals in force in Morocco.
End of occupation:
The customer will leave the premises after the inventory has been established at the end of the rental contract. In the event of the client's departure before the end of the contract, the inventory will be established as quickly as possible by a bailiff appointed by the lessor without the presence of the client. This inventory will be deemed to have been signed for agreement by the customer.
As soon as the contract ends, the lessor will regain possession and occupation of the premises. If the customer and/or his service providers do not leave the premises at the end of the contractual rental period, the customer is liable for a penalty of 36,000DH (thirty six thousand dirhams) including tax per day of delay.
Unless prior agreement is given by the lessor, the client does not have the right to organize any event at Albaicin other than that indicated in the Special Conditions.
In the event that the event agreed with the lessor includes shows and/or musical programs, and/or displays or signage outside the Albaicin, contracted by the client with external service providers, the client will be solely responsible for any request for authorization and/or declaration from the authorities or collective bodies concerned, as well as the payment of taxes, royalties or other contributions due in this respect, including the payment of royalties of author, composer or performing artist. The customer guarantees the lessor against any claim in this respect.
For the organization of any event any type of event which due to its purpose or legal qualification would require any administrative authorization, prior declaration, license or associated formalities in accordance with the legislation in force, the client undertakes to obtain the necessary elements from the competent authorities and to act in compliance with the regulations applicable in Morocco and undertakes to guarantee the lessor accordingly.
The client undertakes not to distribute any information or promotional document relating to the rental and Albaicin in general without having first obtained the written consent of the lessor.
The customer is not authorized to use the Albaicin brand or logo in any way without the written consent of the lessor.
The lessor cannot be held responsible for any breach of the contract to the extent that such a breach is caused by an event of force majeure. The lessor cannot be held responsible for the consequences, whatever they may be, of possible cuts in public networks such as water, electricity, telephone, internet.
During the duration of the contract, the client will be solely responsible for any damage or loss of objects belonging to him or to residents, his guests or participants in the event indicated in the Special Conditions, the lessor declining all liability in the event of theft or damage. object belonging to the customer.
The client is solely responsible for any bodily harm or other damage suffered by him, other residents identified in accordance with article 8 “Administrative formalities” above, his occasional guests, his suppliers or any other person admitted to the premises by him , use of the swimming pool, voluntary or not, or the gym. If the lessor provides baby cot(s) and corresponding linen, the lessor declines all responsibility for the customer's use of this equipment.
The lessor is only responsible for the goods delivered to Albaicin during the contract if the lessor has accepted a mandate from the customer to supply or retain these goods.
The client will be solely responsible, and will therefore be solely responsible, for any damage, bodily or material, of any nature whatsoever, occurring during the execution of the contract, whether that of the residents, their guests or participants in the event. indicated in the Special Conditions. The customer is required to take out for this purpose, at his sole initiative and at his own expense, any insurance, the contract of which must contain a clause waiving any recourse by the customer against the lessor.
The customer agrees to indemnify the lessor against any claim, any lawsuit, any request for damages, any liability action, any judgment, costs and expenses, based on the contract or a tortious act and arising from a breach of the customer , residents or their guests to any of the clauses of the contract, a fault, voluntary or not, an omission of the client, the residents or their guests, or any of their suppliers, agents or subcontractors.
The customer alone is responsible for the services provided by the suppliers contracted by him. The customer will under no circumstances be able to turn against the lessor in the event of irregularities in the services of the suppliers contracted by him.
The lessor has the right to terminate this contract without notice in the event of force majeure or in the event of manifest failure by the customer to fulfill one of its obligations under this contract.
This contract assumes that the borders of Morocco, closed at the time of signing of this contract due to the Covid-19 epidemic, will be open on the rental dates provided for in this contract. If, after reopening the borders, and only in these two specific cases, either the competent public authority again decrees a closure of airspace to airlines preventing the customer from coming to Morocco on the rental start date, or in the event that the client or his spouse tests positive for COVID-19 within 72 hours before departure from their country of residence, the contract is automatically terminated and the client will be entitled to a refund of the deposits paid.
